We would like to take this opportunity to remind you of the importance of complying with State and Federal privacy laws, including the necessity of securing your business’ records. Privacy and cybersecurity threats are becoming more sophisticated every year, and the law is constantly evolving to keep up with these threats. At Saltzman Law, we can help guide you through your legal obligations to protect your employees’ and your clients’ privacy. It is also crucial to test your business’ cybersecurity vulnerability. If you have not looked into your vulnerabilities, we can recommend a service to help you at an affordable price. Vulnerability testing can also reduce the price of cyber insurance, which we strongly recommend. If you have any questions about your legal obligations to protect your business’ records, or if you have any questions about privacy laws in general, please contact us.

Non-competition clauses in employment agreements are generally enforceable in Maryland. However, a recent rise in workers’ rights and anti-monopolist sentiments might find Maryland following California’s lead in significantly limiting the power of these clauses. https://lnkd.in/gm4sd9pc

In Maryland, the declaration of bankruptcy can have the unintended effect of converting ownership interests of real property held as joint tenants to interests held as tenants in common. This can cause a serious impact to your rights as a property owner and can make it increasingly difficult to protect the interests of both you and your heirs. https://lnkd.in/eR7AgMvb

For businesses serving Maryland, the enactment of a proposed new data privacy bill would require a change in privacy policies, consumer request response plans, and business plans based on data collection. Businesses that merely maintain electronic information related to their customers might have to reassess their approach to consumer data. Please see the attached article for more information, and contact our office with any questions. https://lnkd.in/eFWgt9v3

Until October 1, 2023, a judgment creditor had the ability to enforce a judgment made in small claims court in Maryland by way of oral examination (i.e. oral deposition before the court) or through interrogatories. Now, following the enactment of a new Maryland Statute, if you obtain a judgment in small claims court, there is no reliable path to enforce collection of that judgment. Beginning on January 1, 2024, business entities are now required to report certain information regarding their beneficial owners to the Federal Government. The newly enacted Corporate Transparency Act (“CTA”) requires business entities in existence before January 1, 2024, to file Beneficial Ownership Information (“BOI”) with the U.S. Department of Treasury prior to January 1, 2025. For businesses established on or after January 1, 2024, the filing of the BOI must take place within 30 calendar days after registering the entity. The CTA applies to a broad range of business entities, and only twenty-three specific exemptions apply. Pursuant to the CTA, beneficial owners of business entities must report certain personal information to the U.S. Treasury Department. Beneficial owners are also defined under the CTA. If you have any questions about the CTA, or would like us to discuss your obligations in more detail, please contact our office at your earliest convenience, at jsaltzman@saltzman-law.

Lawsuits in Maryland can already drag on for years, but because of a recent trend of new statutes, a party that loses a judgment can now seek reconsideration months—or even years—after that judgment is entered. There are time limits for post-judgment motions and appeals, but the clock for those filings does not start running until a final judgment is entered into the docket and made available to the public. If a trial court fails to enter a final judgment into the docket, and even if both parties are aware of the substance of the court’s order, the clock still does not begin to run. This could theoretically continue for an indefinite period of time, putting prevailing parties at risk. To access this article in full, please visit the link below.
